Terms and Conditions

These general terms and conditions regulate the legal relations between you as a customer (hereinafter referred to as the customer) and Jungfrau Tours AG, concerning travel arrangements or other services provided by Jungfrau Tours AG. These conditions are also legally binding for Internet bookings.

1. Applicabilityback to top

The general terms and conditions apply to bookings directly with Jungfrau Tours when it comprises all-inclusive travel packages for the end-user. In cases where the customer only books individual travel components (e.g. a railticket only), Jungfrau Tours only acts as an agent for the services of the third party (Railway company) and is not contracting partner and therefore not liable for the correct execution of the order. In that case the general terms and conditions of the railway companies, hotels, rental car companies etc. apply.

2. Conclusion of contractback to top

The contract between the customer and Jungfrau Tours is concluded with the unconditional acceptance of your reservation by fax, internet, telephone or letter.

3. Booking procedure, prices and terms of paymentback to top

The actual package price can be taken from the internet or out of the brochure of Jungfrau Tours. For final booking we request names/prenames (children’s birthdate), chosen hotelcategorie, arrival flight number, credit card/exp.date and full home address with phone number and e-mail or fax number. We shall confirm your booking with full details. After your re-confirmation with OK we charge your credit card and send documents either to your home address (surcharge for mailing) or to the the pick-up place in Switzerland (first overnight hotel or arrival airport). The travel arrangement must be payed in advance, latest at the time when documents will be delivered to you.

4. Cancellationsback to top

In case of cancellation after final booking we charge following fees:

Until 30 days prior to arrival = 10% of arrangement, minimum CHF 120.00
29-10 days prior to arrival = 20% of arrangement
09-04 days prior to arrival = 50% of arrangement
03 days to arrival day = 90% of arrangement
No show = 100% of arrangement

For certain periods such as Christmas/New Year, the special cancellation conditions on the confirmation/invoice will apply. Also there will be special conditions for groups and incentive travel.

5. Price changes / Service amendmentsback to top

Changes before conclusion of contract:

We reserve the right to change statements, services and prices prior to your booking. Jungfrau Tours AG is not liable for changes that incur through an act of God or any occurrence which, despite care and attention, could not have been foreseen or avoided by Jungfrau Tours. We do endeavour to inform you as soon as possible.

Price changes after conclusion of contract:

We reserve the right in the following exceptional circumstances to change the agreed price:

  • Rate changes from transportation companies, hotels
  • Newly introduced or higher duty charges or fees
  • State imposed taxes exp. VAT
  • Change of trade fair dates

In the case of changes being made concerning the above reason, price differences will be mentioned the latest 3 weeks prior to departure. In the case of the difference being more than 10% of the original total package price the client has the right to either cancel the contract free of charge within 5 days of notice being given or to accept an alternative tour package of equal value from Jungfrau Tours.

6. Termination of Tourback to top

Cancellation due to reasons of the customer:

Jungfrau Tours can cancel tours in the event of the clients actions or omissions. In this case Jungfrau Tours will refund the travel price. Other demands will not be met. Cancellation fees are obligatory according to 4.

Acts of God, industrial action/strike:

Acts of God, industrial action/strike or civil unrest can persuade Jungfrau Tours to abort travel services. In this event Jungfrau Tours is endeavoured to offer you an alternative tour at equal value.

Cancellation due to other reasons by Jungfrau Tours AG:

Jungfrau Tours can cancel tour for different reasons. In this case we shall contact the customer as soon as possible. You are entitled to the rights under clause 4.

7. Changes in program or services during your tourback to top

In the event of a change in program that would severly affect a part of your trip, Jungfrau Tours will compensate you where applicable the service involved.

8. Premature cancellation of your tourback to top

If for any reason a customer chooses to prematurely end their stay Jungfrau Tours will not be liable for the total amount of your tour package. Where applicable we will refund not used services (20% refund fee) as long as no other costs are charged to Jungfrau Tours.

9. Complaintsback to top

In the case of a tour not meeting the agreement on conclusion of contract or the customer suffering damages from it, the customer is entitled and obliged to inform the service-provider (hotel, railway-company etc.) or Jungfrau Tours AG immediately and request redress.

The service-provider or Jungfrau Tours AG will be endeavoured to provide assistance within a reasonable time frame. Should such assistance prove impossible or inadequate, the customer shall be required to obtain from the service-provider in question written confirmation of the harm or damage suffered and the lack or inadequacy of the assistance provided. The service-provider in question shall be obliged to furnish such confirmation hwoever shall not be authorised to approve any such demans for damage or compensation.

In within a reasonable time fram (48 hours) no assistance is granted and the damage caused is serious the customers are entitled to seek help for themselves. Costs involved will be refunded by Jungfrau Tours AG taken into consideration the tour previously booked “hotelcategorie and chosen transportation” the service-provider in question has given written confirmation of the harm or damage suffered and you have receipts of these costs.

The confirmation of the service-provider and your desired compensation is to be handed in writing within 4 weeks to Jungfrau Tours AG, 3800 Interlaken, afther the agreed end of your tour. If you are not able to meet these conditions your right to all claims of compensation will be lost.

10. Liabilityback to top

Jungfrau Tours AG shall reimburse the client for the value of contracted but not provided services or for any additional expenditure incurred, only if it was not possible for the service-provider tu supply a suitable replacement service on the spot.

In the event of international agreements restricting liabiltiy for inadequate or non-fulfilment of contracts, Jungfrau Tours reserves the right to aply the conditions of such agreements. Such international agreements exist predominantly in the field of transportation.

Jungfrau Tours shall not be liable to the client in non-fulfilment of the contract can be traced to the following causes:

  • Negligence on the part of the client before or during the tour
  • Unforeseen or unavoidable negligence by any third party who is not a party to the contracted provision of services.
  • Acts of God or any occurrence which, despite care and attention, could not have been foreseen or avoided by Jungfrau Tours, the intermediary or service-provider.

In the above mentioned cases Jungfrau Tours shll not be liable for payment of any compensation or dames whatsoever.

In the event of personal harm, death, physical injury or illness arising from incorrect or non-fulfilment of contract by Jungfrau Tours, the company shall assume liability only if such damages occure through fault or Jungfrau Tours or service-providers. Any such liability shall be subject to international agreements (see above).

In the event of loss or damage of property arising from incorrect or non-fulfilment of contract by Jungfrau Tours, the liability of Jungfrau Tours shall be restricted to a maximum sum equal to twice the tour price, unless such damage or loss was caused intentionally or due to neglicence. Amounts of any such liability shall be subject to lower limits limited specified by international agreements (see above).

11. Insuranceback to top

The liability of travel, transport and airline companies is limited. We recommend the clients to arrange appropriate supplementary cover e.g. luggage, accident and illness insurance and where possible repatriation cost insurance. The cancellation cost insurance cover is obligatory and is charged seperately to the tourprice if you are not in posession of adequate insurance cover.

12. Entry, visa and health regulationsback to top

Please enquire at the Embassy or Consulate in your home country. It is the responsibility of the customer for validity of travel documents including necessity of the requirement of a Visa. In the event of a cancellation due to the nonreceipt or late receipt of a travel document, the cancellation conditions shall apply.

Travellers are also responsible to follow the given guidelines concerning entry, health and currency regulations. Please check these regulations as early as possible whether you carry the appropriate documentation.

In the case of entry into a country being declined by the authorities the costs of the return trip are solely those of the client. Also Jungfrau Tours would like to herewith make the client aware of the legal consequences concerning illegal goods and other imports.

13. Applicable law and place of jurisdictionback to top

The contract between the customer and Jungfrau Tours AG is governed solely by Swiss law. The sole place of legislation for any dispute is the city of Interlaken/Switzerland where the headoffice is located.
